As part of its activity as a real estate agent, BERTOLA Real Estate, hereinafter "the Agency", collects and processes personal data of its clients and prospects.
Aware of the importance of ensuring data confidentiality and respect for the privacy of its clients and prospects, the Agency undertakes, in accordance with the provisions of Law n° 1.565 of 3 December 2024 on the protection of personal data, to implement appropriate measures to ensure the protection, confidentiality and security of the personal data collected. The purpose of this policy is to inform clients and prospects of the commitments made by the Agency to ensure respect for their personal data and their rights concerning the processing of such data. This policy may evolve according to the legal and regulatory context.

4. Data collected, purposes and legal bases
The Agency collects only the personal data of its clients and prospects strictly necessary for the purposes of the processing carried out:
4.1 Data collected at the Agency
Prospecting, targeted marketing and personalised communication
- Category: Identification data (title, surname, first name, contact details), real estate project, family and professional situation, financial and asset situation.
- Legal basis: Legitimate interest of the Agency, prospect's consent.
Performance of contractual services
- Category: Identification data, personal and professional situation, financial situation, bank details.
- Legal basis: Performance of a contract or pre-contractual measures.
Compliance with legal and regulatory obligations (in particular Anti-Money Laundering and Combating the Financing of Terrorism)
- Category: Identification data, official documents, origin of funds, asset situation.
- Legal basis: Legal obligation.
4.2 Data collected via the website
Handling and follow-up of contact and information requests
- Category: Surname, first name, email, telephone, message.
- Legal basis: Legitimate interest of the Agency in responding to enquiries.
Submission of properties for sale or rent
- Category: Owner's contact details, property information, photos and documents provided.
- Legal basis: Pre-contractual measures at the request of the data subject.
Audience measurement and technical operation of the site
- Category: Strictly necessary cookies (session, security, language, consent).
- Legal basis: Legitimate interest — operation of the site. No advertising or third-party tracking cookies are used.
5. Recipients of the data
The personal data collected is intended for the Agency's internal services. It may be transmitted to service providers (IT, legal, accounting, notarial) acting as sub-processors, or to competent authorities under legal obligations.
6. Transfer of data outside Monaco
The Agency favours hosting and processing data within the territory of the Principality of Monaco or the European Union. In the event of transfer to a third country, the Agency ensures that the country offers an adequate level of protection in accordance with Monegasque regulations.
7. Data retention period
- Prospects: 3 years from the last contact.
- Clients: Duration of the contractual relationship, plus statutory limitation periods (in particular 10 years for accounting obligations and anti-money laundering).
- Contact requests via the site: 3 years from the last interaction.
8. Data security
The Agency implements appropriate technical and organisational measures to ensure a level of security appropriate to the risk, in particular to protect data against destruction, loss, alteration or unauthorised disclosure (HTTPS encryption, access control, regular backups).
9. Rights of data subjects
In accordance with current Monegasque legislation, you have the following rights:
- Right of access and rectification.
- Right to erasure (right to be forgotten).
- Right to restriction of processing.
- Right to data portability.
- Right to object to processing.
- Right to define directives on the fate of your data after your death.
